Dems Gearing Up For Document Fight Over Obamacare

Five House committee chairmen are now demanding Attorney General William Barr provide documents by May 27 about his decision to stop defending the constitutionality of Obamacare, Politico is reporting.

In a Tuesday letter to Barr, the chairmen noted they have been seeking the documents since April 8.

The letter, which was posted by Politico, is signed by Oversight Chairman Elijah Cummings, D-Md., Energy and Commerce Chairman Frank Pallone Jr., D-N.J., Ways and Means Chairman Richard Neal, D-Mass., Education and Labor Chairman Bobby Scott, D-Va., and Judiciary Chairman Jerry Nadler D-N.Y.

“On April 8, 2019, we wrote to you regarding the Trump administration's devastating decision to reverse the Department of Justice's legal position in Texas v. United States and-for the first time-assert that the entire Affordable Care Act (ACA) should be held unconstitutional,” the letter said.

The five Democrats noted they had received word on April 11 that the Justice Department would work “promptly to respond to our requests.” However, it did not meet a given April 22 deadline.

“Meanwhile, on May 1, 2019, the Department filed a 50-page brief in the United States Court of Appeals for the Fifth Circuit elaborating on the Trump administration's new-and flawed-legal position,” the letter stated.

The administration had joined a coalition of GOP-led state in asking the appeals court to entirely overturn Obamacare.

The chairmen set the new May 27 deadline and noted “we will have no choice but to consider alternative means of obtaining compliance” if Barr does not provide the documents.
