Former FBI Director James Comey says President Donald Trump would have been indicted on charges of obstruction if he were not president.
"If this were a case about someone other than the president, they'd already have been indicted on at least several of these obstruction incidents, maybe all of them, I don't know," Comey told MSNBC host Nicolle Wallace on Tuesday.
Former special counsel Mueller is scheduled to testify before Congress about the Russia probe Wednesday.
In March, Mueller completed his nearly two-year-long probe into Russian meddling in the 2016 election and possible obstruction of justice by President Donald Trump.
The Justice Department released a redacted copy of his 448-page report in April.
Comey also said he believes Mueller, if pressed, would argue there is sufficient evidence to charge Trump on "at least some" of the allegations of obstruction outlined in his report, but Mueller is too principled to say so.
"Director Mueller I think, if pressed, would reach a decision at least on some of them that there is sufficient evidence to charge the president," Comey said. "But again, he's a principled person trying to be fair, and said, 'I shouldn't be doing that given that the man can't vindicate himself.'
"I'd be shocked if he imagined that Bill Barr would take the thing and say 'Oh thanks Bob, no case here, we're closing it.' I'd be shocked."
