Sen. Ted Cruz said on Monday that he challenged Senate Judiciary Committee chairwoman Dianne Feinstein last week in the debate to ban assault weapons because “the Constitution should be the starting basis for everything that Congress does.”
“We should be asking a lot more questions in Congress about the constitutionality for just about everything this body does,” the GOP freshman senator told Fox’s Sean Hannity. “For a long time, a whole bunch of Democrats and, unfortunately, even some Republicans have been passing laws in this body without even asking where the basis is in the Constitution.”
Last Thursday, the judiciary committee voted 10-8 to ban certain types of assault weapons. The vote prohibited the sale and manufacture of 150 different kinds of semi-automatic weapons.
Cruz had asked Feinstein about the constitutionality of the legislation — and the California congresswoman let the Texan know that she was not in need of a lecture on the Constitution.
“I’m not a sixth grader,” Feinstein responded when Cruz asked her position on the Second Amendment.
Cruz, a former state solicitor general, had asked Feinstein to explain how certain guns could be banned despite the Second Amendment and whether she thought constitutional rights — otherwise protected under the First and Fourth Amendments — would be eroded.
