Trump Releases Letter Backing IRS Audit Claim

Donald Trump's campaign released a letter from his tax attorneys Wednesday night saying Trump's tax returns have been "under continuous examination by the IRS since 2002," citing that as a reason for not releasing his returns to the public.

The letter, posted by Politico, from his attorneys, Sheri A. Dillon and William F. Nelson, said his returns from 2009 "and forward" are still being processed, and that is standard practice for "large and complex businesses."

New York Post columnist John Podheretz noted in a tweet:


"Examinations of your tax returns for 2002 through 2008 have been closed administratively by agreement with the IRS without assessment or payment, on a net basis, of any deficiency," said the letter.

Tax lawyer Dennis Barger tells Bloomberg the letter appears to be "internally inconsistent."

During a CNN town hall event, Trump said he would provide the letter, following up on his statement at a GOP debate that he has been audited for "12 years or something like that."

The returns the IRS are looking into now, the attorneys said, involve "continuing transactions or activities that were also reported on returns for 2008 and earlier."

The IRS had said that releasing his returns would be acceptable, even if he was under audit at the time, according to a USA Today report.

In February, IRS Commissioner John Koskinen said it would be "rare" to be audited for multiple years. Noting that "usually when there's an audit, and it's cleared up, and there are no other issues, it's a number of years, two or three at least, before you hear from us again, unless something else pops up," reports The Wall Street Journal.
