Rush: Obama 'Knows About Judicial Review'

President Barack Obama knew exactly what he was doing when he attacked the Supreme Court, and “what he’s doing is more cynical than you can imagine,” talk radio host Rush Limbaugh said on Wednesday.

“What he says [in the press conference] makes it sounds like he doesn’t understand the concept of judicial review,” Limbaugh said. “Obama implicitly implied that he doesn’t know [about judicial review] and there have been a number of commentators reacting to Obama as though they really think he doesn’t know what judicial review is.”

On Monday, Obama said that the Supreme Court's upcoming ruling on the 2010 Affordable Care and Prevention Act would be engaging in “judicial activism” if the court decides to throw out the law.

Throwing out the healthcare reform law would be an “unprecedented, extraordinary step” on the Supreme Court’s part, demonstrating a lack of “judicial restraint,” said Obama. He believes that the justices should follow legal precedent and uphold the law's constitutionality.

Many critics are saying that Obama must not know anything about the judicial review process, specifically the 1803 landmark Marbury vs. Madison Supreme Court case, that formed the basis for judicial review which helped to define the boundary between the executive and judicial branches of government.

Limbaugh, however, disagrees with the critics and says that Obama knows exactly what he is doing.

“Obama goes out, says what he says about the court never overturning laws passed by Congress and everyone is blown away by how stupid he is,” Limbaugh said. “He’s not stupid. He knows about judicial review. He’s heard of Marbury vs. Madison. That’s not what he’s doing here. What he’s doing is even more cynical than you can imagine.”

“I’m shocked that anybody thinks that Obama doesn’t know what judicial review is . . . He knows what judicial review is. He knows the Supreme Court determines what’s constitutional and not.”
