President Donald Trump should immediately reissue his executive order on travel from the Middle East, but include more details about what it does and does not cover, Rep. Louie Gohmert said Friday, while accusing the 9th Circuit appellate court of not caring about the Constitution while upholding an order on the travel ban.
"Include in there what the White House had already explained, that it didn't apply to people that already had their green cards," the Texas Republican told Fox News' "Fox & Friends" program.
"That addresses the issue that the 9th Circuit raised. Even for people that don't care about the Constitution like the justices on the 9th Circuit, that ought to take care of it."
And if that doesn't work and someone else challenges the executive order," it ought to be "somebody that cares about the Constitution, perhaps in the 5th Circuit," Gohmert said.
The appeals court's decision, which blocks Trump from restoring his executive order, did not mention the law that gave the president the power to enact it, the lawmaker continued.
"The 9th Circuit has got to go," he insisted. "I think we just scrap it and create two new circuits."
Trump was trying to protect the American public with the order, Gohmert said, and had information he relied on to help America.
"I think it's time to move forward," he said.
