President Donald Trump will name "somebody who is in the mold of original thinker and somebody who shows fidelity to the Constitution" when he announces his nominee to replace retiring Supreme Court Justice Anthony Kennedy on July 9, presidential counselor Kellyanne Conway said Monday.
"I guarantee it will be somebody who has fidelity to the Constitution and doesn't make up the law as they go along," Conway told Fox News' "Fox and Friends," while refusing to speculate who Trump will pick.
"Too many judges these days in our federal courts, in my view are making things up as they go along, legislating from the bench, subject to the polls, the protesters, the political whims," she added. "The fidelity is to the Constitution. If you don't like the Constitution, amend it."
Conway also pointed out as soon as Trump announced he'd be selecting Kennedy's successor, he started in his "advise and consent role" with the Senate, meeting with both Democrats and Republicans.
Trump also made it clear during an interview with Fox News'' Maria Bartiromo over the weekend that he will not be asking prospective nominees specific questions about how they'll rule on cases, including the controversial Roe v. Wade decision.
"This president wants somebody who has great experience, deep intellect," said Conway. "But I am amazed how yet again, the left boils everything single thing, including a Supreme Court justice down to one issue, abortion. No wonder the Supreme Court just last week held against the abortion folks and in favor of the crisis pregnancy centers out in California in saying that crisis pregnancy centers don't have to tell someone that they can actually get an abortion if they are not choosing to. Unless you live under a rock with an eye mask and ear muffs on you pretty sure you know that you can get an abortion in this country."
She also hit back at Democrats who have said they will not vote to approve a Trump SCOTUS nominee.
"Well, that's too bad," she said. "They should have elected their person president, I suppose."
