Sen. Bob Menendez, D-N.J., became the last Democrat on Monday to support his party's filibuster and opposition to Supreme Court nominee Neil Gorsuch.
"Based on his record, judicial philosophy, and indirect and evasive answers during the hearings, I cannot support either cloture or final passage on Judge Gorsuch's nomination," Menendez wrote in a statement posted on Facebook.
Menendez joined 41 other Democrats and Sen. Bernie Sanders, I-Vt., in announcing his stance, The Hill noted.
Sen. Michael Bennet, D-Colo., said he will not support the filibuster but has not said how he will vote on confirmation, The Hill reported.
Also, Sen. Angus King, I-Maine, who caucuses with Democrats, has not said how he will vote on either the filibuster or confirmation.
