Trump's SCOTUS List Changing 'Day to Day'

President Donald Trump's Supreme Court nominees list of 21 candidates "can change day to day" as he searches for a "mainstream" justice that will pass the strict test of liberals in the Senate, an administration adviser said.

"I think there's a hope that Democrats will recognize that the balance of the court doesn't change with the appointment of this next justice," Federalist Society executive vice president Leonard Leo told Fox News.

"Secondly, I think there's a hope that if the president nominates someone who is extraordinarily talented, strong intellectually, and is in the mainstream of legal thought —and all of these people we're talking about are — that while there will be lots of debate and some disagreement, the Senate ultimately will confirm the nominee without a high degree of obstruction."

Trump's entire list of 21 right now were President George W. Bush appointees, according to Fox News. Trump's sister, Judge Maryanne Trump Barry, serves on the U.S. 3rd Circuit Court of appeals, but would not be a candidate because of a "total conflict of interest," Trump has said. 

 

 

The seat will fill the one vacated by conservative Justice Antonin Scalia, who died suddenly last February.

Leo designated three top candidates with the following remarks to Fox News:

  • 10th Circuit Court of Appeals Judge Neil Gorsuch of Colorado: "Very distinguished record of judicial service" and "has executive branch experience" from the George W. Bush administration. He is just 39 and would have a long tenure in the SCOTUS.
  • Third Circuit Court of Appeals Judge Thomas Hardiman of Pennsylvania: "He's interesting because he was both a trial court judge in the federal system but also a court of appeals judge so it's a slightly different range of experience."
  • 11th Circuit Court of Appeals Judge William Pryor of Alabama: "He's well known to the conservative movement" in the "mold of Scalia" and "someone who knows a lot about both the criminal law and constitutional law."
