Judge Napolitano Backs Trump's 'Perfectly Valid' Complaints

Fox New's "America's Newsroom"

By    |   Wednesday, 08 February 2017 02:13 PM EST

Fox News commentator Andrew Napolitano slammed the district court judge who halted President Donald Trump's executive order on immigration, along with other court officials, for asking political questions when reviewing the legality of Trump's order.

Trump's order was blocked by the 9th Circuit Court of Appeals in San Francisco, specifically by Judge James Robart, who the president later called a "so-called judge," according to Fox News.

On Wednesday Trump took to Twitter to voice his complaints.

"My impression is that the president has a very legitimate complaint that the judges sounded political," Napolitano said on "America's Newsroom" Wednesday.

"My late friend, the great Justice [Antonin] Scalia, used to have as a joke a sign on his desk with three words on it: 'Stupid but constitutional.' Basically saying I don't care what the government did. I only care if it's constitutional," Napolitano continued.

He added that Judges Michelle Friedland, William Canby Jr., and Richard Clifton of the 9th Circuit Court of Appeals questioned the "wisdom," and not the legality, of the order, and that Trump has "perfectly valid" complaints in light of his administration's argument that the order is a matter of national security.
