Dershowitz: Rosenstein Can't Play Witness and Prosecutor

Deputy Attorney General Rod Rosenstein has no business not recusing himself from the Department of Justice's Russia investigation, attorney Alan Dershowitz said Monday.

Dershowitz was on Fox News and said Rosenstein should not be overseeing the special counsel probe led by Robert Mueller.

"He is a witness in this case," Dershowitz said. "The idea that you can be the chief prosecutor and the main witness at the same time is such an obvious conflict of interest that I don't understand how he can continue to go forward running this investigation.

"We have at least two major conflicts of interest. I think it does raise some questions about the integrity of the investigation."

Dershowitz went on to allege Mueller, who served as FBI director from 2001-2013, "is a zealot prosecutor."

"Mueller is non-partisan," Dershowitz said. "He is a zealot prosecutor and using tactics that I have disapproved of for 50 years. Going after [former Trump campaign chairman Paul] Manafort to squeeze him to get him to sing. Those are questionable tactics. But they are used over and over, sometimes against innocent people."
