George Conway, husband to White House counselor Kellyanne Conway and a frequent critic of President Donald Trump, Thursday claimed the president used a "misleading" statistic when he said the U.S. Court of Appeals for the 9th Circuit in California is overturned more than any other circuit court in the country.
On Thursday, while doubling down on his attacks on Chief Justice John Roberts, Trump tweeted the California court has a "horrible reputation" and that 79 percent of its cases are overturned, making it a "horrible disaster.."
But Conway, presenting a series of statistics, tweeted that Trump's numbers are misleading, reports Law and Crime.
"The reversal rate for all courts in the Supreme Court last year was 74%," Conway tweeted. "All these statistics tell us is that one major factor in the Supreme Court’s selection of which cases to review is whether they may have been wrongly decided."
He also added that “number of Ninth Circuit cases reviewed and reversed was high" but "the Ninth Circuit is by far [the] largest federal circuit by number of judges and size of docket.”
Further, said Conway, the Supreme Court does not take on cases usually to affirm them, "which is why the statistic is citing is misleading. As Adam Liptak wrote in yesterday’s New York Times, the Ninth Circuit covers ‘a fifth of the nation’s population and a third of its land, in nine states and two territories’ — hence the huge docket.”
