President Donald Trump will most likely be interviewed at some point by Special Counsel Robert Mueller's investigative team, Judge Andrew Napolitano said Thursday, while denying claims by the president's lawyers that he won't be questioned.
"My belief is that the president ultimately will be interviewed," the Fox News senior judicial analyst told "America's Newsroom" host Bill Hemmer. "He will be interviewed to see if he tells the truth. It's a favorite technique of the FBI."
He added that he agrees with an opinion piece by Fox's Gregg Jarrett that if the probe continues to go on, it could damage the president's ability to negotiate with Russia and its president, Vladimir Putin.
"That is the problem with independent counsels, they have a tendency to want to justify their behavior," Napolitano said. "A team of lawyers, very skilled aggressive experienced prosecutors, a team of FBI agents, the best that Bob Mueller can get from his former colleagues, outside the normal chain of command, not answerable through the normal chain of command wanting to justify their existence by indicting people."
And often, he added, such probes can end with indictments that have nothing to do with the initial purpose of the investigation, in this case concerning Russia or Trump's 2016 presidential campaign.
In a Thursday Fox News opinion piece of his own, Napolitano said he's concerned that Thanksgiving already has passed, but Mueller's investigation is still continuing, even though the president's attorneys assured him in August that the probe would have ended by the holiday.
However, last Wednesday, Flynn's attorneys backed out of a joint agreement, meaning "they can no longer comply with the terms of the agreement because they are about to have communications with Mueller's team that they cannot share with the lawyers for the others," wrote Napolitano.
On Thursday, Napolitano told Hemmer that he's seen evidence that there was legal communications between Trump's associates and Russia, but saw no evidence of any agreement about the election.
"Communication is not a crime," Napolitano said. "Agreement with a foreign power to help you when you are running a federal campaign is a crime. I have not seen evidence of that."
